Adult Content and Deep Fake Content – Latest AN 8201 Updates for the Business Risk Assessment and Mitigation Program (BRAM)
Mastercard has updated its Adult Standards FAQs to further clarify consent and adult content requirements. In summary, if consent cannot be established, the content is considered to be in violation of the adult content and services requirement, and therefore must not be published or removed immediately. Furthermore, if the content features an image, likeness or use of deepfake content of an actual person who has not given consent, it is considered in violation of Mastercard’s requirements. Where a merchant should disagree with reports regarding a lack of consent, Mastercard permits the use of a neutral arbitrator to resolve any disagreements – at the expense of the merchant.
